Members

The Board of Adjustment consists of five members appointed by the Mayor. Each serves a 5-year term.  No more than two of the five members may also be appointed to the Plan and Zoning Commission.  A majority of the members shall be representatives of the public at large and shall not be involved in the business of purchasing or selling real estate.

Purpose

The duties of the Board are outlined in Chapter 156.I.003 of the Marshalltown Code of Ordinances, as well as the Iowa Code.  This group hears appeals related to the denial of permits or interpretations issued by the Zoning Administrator.  This group also hears requests for variances from the zoning regulations as well as requests for special uses including home occupation special use permits.  This is a quasi-judicial board that acts similarly to a judge and has the authority to allow the use of the zoned property for a non-conforming use or extension of a non-conforming use as provided in the Zoning Ordinance.  If an applicant disagrees with the Board's decision on a Variance, Special Use, or Appeals, they would appeal to the court system. Board members are not at liberty to discuss applications outside of a public meeting.
